Applicability and terms

These general terms and conditions apply to all products, quotations and agreements of Lattestore.be, Lattestore.nl and lattestore.fr. Before any agreement can be concluded, you must agree to these general terms and conditions.

Lattestore.be, Lattestore.nl and lattestore.fr are registered with the Crossroads Bank for Enterprises under company number 0648888527, hereinafter referred to as Lattestore. Lattestore offers its customers the opportunity to purchase products from its online shop.

We deliver our products in Belgium, France, the Netherlands and Luxembourg.

To place an order, you must be at least 18 years old. If you are under 18, we ask that the order be placed by your parents or legal guardian. If we find that an order has been placed by a minor, we may refuse that order.

Placing an order via the website constitutes express acceptance of our general terms and conditions of sale, which are always available on the website.

When you place an order online, we will also provide you, together with the order confirmation or at the latest upon delivery, with a copy of these general terms and conditions in a format that you can save or print. We recommend that you always do so.

If, in addition to these general terms and conditions, special conditions also apply, the above shall also apply to those special conditions. If there is any conflict between the general terms and the special conditions, you as the consumer may always rely on the provision most favourable to you.


Our offer and your order

If an offer is only valid for a limited period or is subject to specific conditions, we will expressly state this in our offer.

We always describe as fully and accurately as possible what we are selling and how the ordering process works. In all cases, the description is sufficiently detailed to enable you to make a proper assessment. Where we use images, these are a truthful representation of the goods and/or services offered. Mistakes can, however, occur. If we have made an obvious error, we are not obliged to supply the goods nevertheless.

Your order is complete and the agreement between us becomes final as soon as we confirm your order by email, or as soon as we have received approval from the card issuer for your payment transaction by credit or debit card.

We accept Maestro, Visa, Mastercard, PayPal, bank transfer, Mister Cash, Belfius Direct Net, KBC Online, CBC Online, ING Home’Pay and iDEAL. If the issuer of your card refuses to approve your payment, we cannot be held liable for delays in delivery or for failure to deliver your order. Orders without valid payment in the name of the registered cardholder will not be accepted or processed.

To purchase a product, add it to your shopping basket. You then enter your contact details and invoicing details. Next, you choose your delivery method: Ontime, UPS, GLS or DHL. In the final step, you are shown an overview page, you accept our general terms and conditions and confirm your payment by clicking the order button marked “confirm order”. Once you have completed these steps, your purchase is final.


Prices

All prices are stated in euros, in accordance with the applicable legal provisions, and include VAT. The stated price relates exclusively to the items as described in words. The accompanying photographs are for illustrative purposes only and may contain elements that are not included in the price.

We may decide to charge shipping costs in addition to the purchase price. In that case, we will always make this clear before you confirm your purchase.


Payment

We only accept payments via the payment modules on our website. To ensure secure online payment and the protection of your personal data, transaction data is transmitted over the internet using SSL technology. You do not need any special software to pay via SSL. You can recognise a secure SSL connection by the padlock in your browser’s status bar.

If you pay by bank transfer, the agreement becomes final as soon as we confirm your order by email or as soon as we have received the transferred funds. The order only goes into production once payment has been received or once the customer has been informed that the order is going into production. From that point onwards, the order is final and can no longer be cancelled.


Warranty

A two-year manufacturer’s warranty applies to the items supplied by Lattestore. The warranty covers all visible defects and defects recognised by Lattestore’s suppliers. Wear and tear or damage caused by the customer is excluded from the warranty.

Insofar as this is possible and reasonable, you may choose between repair and replacement. Only where repair or replacement would be disproportionate or impossible, or cannot be carried out within a reasonable period, are you entitled to request a price reduction or termination of the sales agreement.


Offer

If the customer has specific questions regarding, for example, dimensions, colour, availability, delivery time or delivery method, we ask the customer to contact our customer service department in advance.

The offer is always valid while stocks last and may be changed or withdrawn by Lattestore at any time. Lattestore cannot be held liable for a product being unavailable. If an offer is valid for a limited period or subject to conditions, this will be expressly stated in the offer.


Dimensions and finish

All products are made to measure according to the specifications provided by the customer. We do not make any corrections ourselves.

The height of a system with ladder cords or ladder tapes may differ slightly from the requested height. These deviations are due to tolerances in the cords and ladder tapes. Lattestore always aims to keep these tolerances as small as possible.

For horizontal blinds, Roman blinds and vertical blinds, we ask that you always deduct 2 cm from the height to ensure easy installation. For vertical systems, the height you provide when placing your order is the height of the complete system, including the rail and slats.


Transport and delivery time

All goods and services are delivered to the address you specify when placing your order. Once the order becomes final, the delivery time is determined. The stated delivery time is indicative only and excludes the time required by the carrier to deliver the order. No rights may be derived from this.

If the expected delivery time is exceeded, the customer will be informed accordingly. Deliveries are made only according to product availability and in the order in which orders are received.

All our shipments are made at our risk. You therefore do not need to worry about goods that are lost during transport. Upon delivery of the goods, you must check the packaging for damage. If you notice damage to the packaging, you must open it while the driver is still present. If you discover damage to the products, you must draw up a damage report together with the driver and return the goods with the driver.

We cannot be held liable for any consequential loss caused by late delivery or non-delivery by the carrier appointed by the company. In such cases, our liability shall remain limited to the value of the items proven not to have been received by the customer.


Force majeure

In the event of force majeure, we are not obliged to fulfil our obligations. In that case, we may either suspend our obligations for the duration of the force majeure event or terminate the agreement permanently.

Force majeure means any circumstance beyond our will and control that prevents the fulfilment of our obligations in whole or in part. This includes, among other things, strikes, fire, business interruptions, power failures, failures in a telecommunications network or connection, failures in communication systems used, the temporary unavailability of our website, and late or non-delivery by suppliers or other third parties engaged by us.


Intellectual property

Our website, logos, texts, photographs, names and, in general, all our communications are protected by intellectual property rights belonging either to us, or to our suppliers or other rights holders.

It is prohibited to use or make changes to the intellectual property rights described in this article. For example, you may not copy or reproduce drawings, photographs, names, texts, logos, colour combinations or other elements without our prior and express written consent.


Complaints

Despite the great care taken with our products and shipments, it may happen that a customer is not satisfied with their purchase. The customer must notify Lattestore’s customer service department within 48 hours of receiving the order. The complaint must be described in detail and supported by photographs.

Lattestore will then seek a solution in consultation with the customer within 7 days.

All agreements we conclude with our customers are governed exclusively by Belgian law, regardless of the customer’s place of residence. In the event of disputes, only the competent Belgian courts shall have jurisdiction. If, for reasons of private international law, another law should nevertheless apply, the interpretation of these general terms and conditions shall first refer to Belgian legislation on market practices and consumer protection.

For out-of-court settlement of disputes, the Consumer Ombudsman Service of the FPS Economy is authorised to receive any request for out-of-court settlement of consumer disputes. It will either handle the request itself or forward it to a qualified entity.

Should we nevertheless fail to resolve the matter together via our internal complaints service on +32 56 90 66 77, you as a consumer may also contact Safeshops.be via info@lattestore.be. or via the contact form on the website. Safeshops.be will mediate between you as the consumer and us, provided that your complaint is accepted by them. Only complaints submitted via the Safeshops complaints form will be handled.


Retention of title

The delivered items remain the exclusive property of Lattestore until full payment has been made by the customer.


Delivery

From the moment the product is delivered, the risk passes to the customer, without prejudice to liabilities which Lattestore cannot legally exclude.


Right of withdrawal

The customer may not exercise the right of withdrawal for the products offered by Lattestore. The goods are manufactured according to the customer’s specifications and are clearly intended for that customer. These are therefore made-to-measure goods. Under no circumstances may such goods be returned.


Liability

Lattestore is not liable for damage to products caused by normal wear and tear or improper use of the product. Lattestore is also not liable for accidents occurring during the use of the products. The products must be checked regularly for loose parts.

Lattestore is not responsible for viruses or other harmful elements that may inadvertently be sent along with email messages. You must check attachments yourself for viruses.


Child safety

Following a decision taken at European level, stricter standards now apply in Europe to the internal sun shading product group (EN 13120), together with two additional standards designed to protect against strangulation risks caused by cord or chain loops for children (EN 16433 and EN 16434).

Which products fall under this standard?

All internal sun shading systems in our range that are operated by means of cord or chain loops.

Where does this standard apply?

To internal sun shading intended to be installed in homes and in buildings or rooms where children aged 0 to 42 months are likely to have access or be present.

The general rule is that the operating mechanism must always hang at least 150 cm above floor level. Each product is supplied with a safety device that must be used to secure the chain or cord laterally under tension. This is intended to prevent young children from putting their heads through a cord or chain loop and thereby reduce the risk of strangulation.

If anything is unclear, the customer must contact Lattestore or the installation team.

Lattestore supplies only products that comply with these standards. The installer ensures that the systems are installed correctly and also informs the customer of the importance of correct installation and proper use of this safety device.

If, after installation by Lattestore, third parties make changes to the product or its installation that are not in line with the child safety requirements, Lattestore cannot be held responsible for this.

The customer consequently indemnifies Lattestore against any responsibility and liability, as well as against any possible damage and/or claim that may arise from inaccurate information provided by the customer.


Colour and liability

The photographs of samples and products have been made in high resolution. The colours displayed on screen may differ from the actual colours.

We recommend setting the screen resolution to 800 x 600 or higher and the colour depth to 16 bit or 32 bit. Most computers are capable of displaying 16.6 million colours at once in 32-bit mode. Lattestore will not issue refunds or provide replacements if the complaint concerns a colour difference only and no sample was requested in advance.

The customer must also take into account that natural products are used. Natural products generally discolour more quickly than synthetic products. Artificial light can cause discolouration just as much as, or even more than, natural daylight. Therefore, wooden blinds should never be placed in a damp room or too close to a heat source.


Assembly and installation

If assembly and installation form part of the agreement between Lattestore and the customer, they shall fall under Lattestore’s responsibility only insofar as the goods supplied by Lattestore are concerned. If necessary, the customer must make available, at their own expense, all assistance and materials required for assembly and installation.

If assembly and installation are carried out by the customer, they are entirely the customer’s own responsibility and liability.


Penalties for non-payment

In the event of late payment by a consumer, we will first send a free payment reminder. From the third calendar day after the reminder has been sent by e-mail, or from the seventh calendar day after it has been sent by post, a period of 14 calendar days will start to run. During this period, the consumer may pay the outstanding amount without any additional charges.

Only after this period has expired may late-payment interest and/or a fixed compensation fee be charged, provided this is legally permitted and within the limits set by law.

Separate payment terms may apply to professional customers.


Evidence

The customer accepts that electronic communications and back-ups may serve as evidence.


Applicable law and competent court

In the event of a dispute arising from the application or interpretation of this agreement, only the courts and tribunals of the judicial district of Kortrijk shall have jurisdiction.
